These Terms of Service ("Terms") govern your access to and use of the website, content, Discord community, and membership services (collectively, the "Services") offered by The Evidence Desk LLC ("The Evidence Desk," "we," "us," or "our"). By purchasing a membership, accessing our Discord, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old and capable of forming a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that all information you provide is accurate.
Memberships are sold through our third-party provider, Whop, and access is delivered primarily through Discord. We offer one-time, subscription, and other plan types as described at checkout. You are responsible for maintaining the security of your Whop and Discord accounts. Access is personal to you and may not be shared, resold, or transferred.
All payments are processed by Whop and its payment partners. Prices are shown at checkout and may change at any time, but changes will not affect plans you have already purchased except where a recurring plan renews at a disclosed rate. Recurring plans renew automatically until cancelled. You authorize recurring charges where applicable.
Refunds and cancellations are governed by our Refund & Cancellation Policy, which is incorporated into these Terms.
All content provided through the Services — including strategies, the "Kill List," the "Edge Bank," code, written materials, videos, AI agents, and community resources — is owned by The Evidence Desk LLC or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the content for your own individual, non-commercial educational use.
You may not: copy, redistribute, publish, sell, sublicense, or share the content or your access; scrape or bulk-download materials; reverse engineer provided code beyond what applicable law permits; or use the content to build or operate a competing product or service.
You agree not to: violate any law or third-party right; harass, abuse, or harm other members; post unlawful, infringing, or misleading content; share other members' information without consent; attempt to gain unauthorized access to the Services; or disrupt the community or its infrastructure. We may remove content and suspend or terminate access for violations.
The Services are for education only. Any examples, strategies, backtests, or commentary are general in nature and not tailored to your circumstances. You are solely responsible for your own trading and investment decisions and for evaluating the risks involved. Trading involves substantial risk of loss. Do not trade with money you cannot afford to lose.
The Services rely on third parties including Whop, Discord, and our hosting and email providers. Your use of those services is subject to their own terms and policies. We are not responsible for the acts, omissions, or availability of third parties.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any result (educational or financial) will be achieved.
To the maximum extent permitted by law, The Evidence Desk LLC and its members, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, trading losses, data, or goodwill, arising out of or related to the Services. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Services will not exceed the amount you paid us in the twelve (12) months before the claim arose.
You agree to indemnify and hold harmless The Evidence Desk LLC and its members and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right.
We may suspend or terminate your access at any time for violation of these Terms or for conduct we reasonably believe is harmful to us, other members, or third parties. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The exclusive venue for any dispute not subject to arbitration will be the state or federal courts located in Florida, and you consent to their jurisdiction.
